  • Recommended Motion:

    THAT Application for Consent B1-23 requested by Monteith Brown Planning Consultants on behalf of 2819842 Ontario Inc. to sever a parcel of land having a frontage of approximately 75 metres (246 ft) and an area of approximately 0.6 hectares (1.5 ac) containing an existing dwelling from a property known municipally as 136 Cromarty Drive and 156 Cromarty Drive, be approved, subject to the following conditions:

    1. That the Certificate of Consent under Section 53(42) of the Planning Act be given within two years of the date of the notice of the decision for each consent.
    2. That the applicants be required to obtain a rezoning to recognize the existing dwelling as a permitted use and to recognize a reduced lot area of 0.6 hectares (1.5 ac) compared to the minimum lot area requirement of 1.5 hectares (3.7 ac).
    3. That the applicant initiate and assume, if required, all engineering costs associated with the preparation of a revised assessment schedule in accordance with the Drainage Act, RSO 1990, as amended, with such costs to be paid in full to the appropriate engineering firm prior to the stamping of the deeds, all to the satisfaction of the Drainage Superintendent.
    4. That all applicable property taxes, municipal fees and charges be paid to the Municipality prior to the stamping of the deeds.
    5. That all outstanding work orders or by-law enforcement issues be resolved to the satisfaction of the Chief Building Official prior to the stamping of the deeds.
    6. That the applicant be required to satisfy all requirements with respect to on-site private sanitary waste disposal system and the potable water supply on the lands to be severed to the satisfaction of the Chief Building Official.
    7. That the necessary deeds, transfers and charges for certificates and/or instruments necessary for registration be submitted electronically.
    8. That an electronic version of a deposited reference plan be submitted to legally describe the lands affected and in general conformity with this decision, all to the satisfaction of the Municipality.

    REASONS

    • The application is consistent with the Provincial Policy Statement.
    • Conformity with the County Official Plan and Municipal Official Plan would be maintained.
    • The requirements of the Zoning By-Law are capable of being satisfied through the requested rezoning.
    • The matters set out in Section 51(24) of the Planning Act would be satisfied.

  • Recommended Motion:

    THAT Application for Zoning By-law Amendment (Z2-23) requested by Monteith Brown Planning Consultants on behalf of 2819842 Ontario Inc. for lands legally known municipally as 136 Cromarty Drive and 156 Cromarty Drive, be approved in principle and that the Director of Planning and Development Services be directed to prepare the necessary Zoning By-law Amendment for Council’s consideration at the next regular meeting once a deposited reference plan has been received which legally describes the lands affected.

    THAT Application for Zoning By-law Amendment (Z2-23) filed by MHBC Planning on behalf of Amanda Forbes for lands known municipally as 3831 Elgin Road to rezone the subject property from the Agricultural (A) zone to a site-specific Agricultural (A-#) zone to permit the construction of a building containing an Additional Residential Unit (ARU) with a maximum floor area of 189 square metres and also comprised of garage space and covered porches with a total floor area of 300 square metres, be approved in principle and that the Director of Planning and Development Services be directed to prepare the necessary Zoning By-law Amendment for Council’s consideration at the next regular meeting.

    THAT the Municipally-Initiated Housekeeping Amendment to the Thames Centre Comprehensive Zoning By-law, be approved in principle and that the implementing by-law be prepared and forwarded to the next available meeting of Council for consideration;

    AND THAT the rezoning of lands for properties known municipally as 3855 Cromarty Drive, 3908 Mossley Drive and 4128 Mossley Drive from Extractive Industrial (M3) to Agricultural (A) be deferred and considered as part of the statutory Zoning By-law update following the approval of the Official Plan review by the County of Middlesex.

    THAT Council adopt in principle Amendment No. 28 to the Thames Centre Official Plan with respect to new policies governing complete application requirements and the optional delegation of authority to pass minor zoning by-law amendments;

    AND THAT the implementing by-law to adopt Amendment No. 28 be forwarded to the next regular meeting of Council for consideration of approval;

    AND THAT staff subsequently forward Amendment No. 28, as adopted, to the County of Middlesex for consideration of approval being the delegated approval authority.

    THAT the Public Meeting adjourn and Council reconvene its regular meeting in order to continue with its deliberations.
